Asked on announcement of the decision by "City Paid Hearing Officer" at the Administrative hearing if I intended to Appeal this hearing decision, and I replied "positively". Therefore they were on notice this matter and the city action was being appealed.
Normally, fines etc are put on hold until a ruling upholding it by the appeals judge, but the City Attorney asked the administrative judge to put
into writing in the ruling that the fine must be paid "immediately" despite an appeal, which of course the "administrative hearing attorney" hired by the city attorney promptly did.
Notice of Appeal to the circuit court was Mailed City Attorney Notice on Monday.
Tuesday we are mailed a notice by the city that we have not paid the fine. We have a canceled check in our December Statement saying we did. Tuesday, the city health department sends another "Health Department" violation ticket, over the same yard and action, a matter we have under appeal to the circuit court.
The ante on the new ticket has now been upped to a fine of two hundred dollars.
We call the city employee that wrote the ticket and asked how come you write another ticket when your very "right to do so" is under appeal? Answer "because the City Attorney told me to."
APRIL 17TH UPDATE: This was an illegal act by the city, issuing another fine while the first one was under appeal, an average unsuspecting public would have "unknowingly" went ahead and paid it. We called them on it with this article and an appeal for an administrative hearing. The "fake judge" hired by the prosecutor would only be able to rule to throw this out, too obviously an illegal act by the city. I flew back 1200 miles the night before the Administrative Hearing date, (The Usual "fake play acting" Appeal) Spent a lot of time preparing to "blow them out of the water, legally". Two hours before the Administrative hearing April 17th, they notify us the Ticket has been canceled and the hearing dropped. This is the same unethical trick they use on the average citizen, telling them there is a Circuit Court Appeal, let them pay the filing fee. The frustrated citizen, deceived into thinking they are going to get some justice and relief here, pay the filing fee and then hire and pay in advance an expensive attorney, spend a lot of time, money and effort putting their appeal together, and then just before the hearing date the City Attorney office file an action to cancel and nullify the hearing. This is the kind of government citizens should be actively taking action to throw the bums out. Usually, they can and have been getting away with this sort of malarkey, but by this method, we are spending time and money exposing and calling your attention to what kind of government you have in place and now it is up to you to do something about it.
