This Ruse Simplified:

1. When Hitler made a ruling, that was it....obey ruling or else.
   

    

2. In the United States, (except Sioux Falls) we have a constitution that protects us from abusive government agents gone berserk. The US Constitution Guarantees Citizens You are entitled to have any government action reviewed by a legitimate independent court system. If the court agrees it is out of bounds, the action is nullified.
   

    

3. The City Of Sioux Falls skirts around this and denies you judicial review of their rulings by:

    

   • Setting up a sham administrative hearing

      

   • You are right off declared "guilty" and it is up to you to prove you are "innocent" of your property being involved in any wrong doing.

      

   • Here the prosecutor hand selects the "reviewer" and they are on his payroll. This party (play acting as Judge,) "stamps approved" any city action and your chances here are almost nil, just an "appearance" of granting you an appeal of the City Action against you or your property.

      

   • The City then tells you that this is okay because you have the right to appeal that decision to the Circuit Court.
     

      

   • You pay the money for the circuit court appeal.
     

      

   • You spend money on an attorney
     

      

   • The City ordinance says you may appeal to Circuit Court.
     

      

   • When you appeal the City Automatically Files legal papers notifying the Circuit Court they have to dismiss it because the City Ordinance never spelled out the provisions necessary for an appeal.

      

   • The Circuit Court throws out your appeal because the City never provided the necessary wording in the ordinance to facilitate a Circuit Court Appeal.

      

4. You have been had. All the money you spent on your appeal was merely adding insult to injury.

    

5. You wasted your time and money in an outright City Fraud.

    

6. Biggest fraud is you are DENIED ANY REVIEW of the City "Police Action" on your property, you wind up with no avenue of review whatsoever by a legitimate court and the city action stands totally free of being contested.

   Their ritual game playing does not meet constitutional muster and will fail if exposed in Federal court.

    

7. The City therefore has the POWER to do whatever they want unrestrained by any review using this clever "Catch 22" ruse, and their unconstitutional actions continue unabated with new 'CITIZEN VICTIMS" every day of this property harassment.

   This is the equivalent to taking their property with out compensation by totally limiting legitimate use. They can do whatever they like, at will and you have been rendered powerless to do anything about it.

    

8. If you continue to allow this type of abusive government to continue unabated....and do nothing, you deserve abusive government, and it will eventually bite, you, not always your neighbor.

Yours (and mine) and all Sioux Falls citizens, only recourse is to join together in a class action in Federal Court to assert our constitutional rights, seek damages and reversal of past actions denied legitimate guaranteed constitutional hearings and recover monetary damages.
